Однако, как следует из материалов дела, земельный участок, на котором расположен спорный объект (ГРУ), не принадлежит истцу на каком-либо праве. Правообладателем данного участка является третье лицо - КГУП «АХУ».

Суд установил, что ГРУ принадлежит на праве собственности ЗАО «Влад Мотор Инн корпорейшн», создана для обслуживания принадлежащего ЗАО «Влад Мотор Инн корпорейшн» здания гостиницы, связано со зданием гостиницы общим назначением и в соответствии со ст. 135 ГК РФ является принадлежностью здания гостиницы.

В силу ст. 69 АПК РФ обстоятельства, установленные данным решением суда, имеют преюдициальное значение при рассмотрении настоящего дела.

Факт того, что нахождение ГРУ на участке препятствует истцу в пользовании объектами недвижимого имущества, принадлежащими ему на праве оперативного управления, истцом в нарушение ст. 65 АПК РФ не доказан.

На основании вышеизложенного исковые требования не подлежат удовлетворению.[17]

Основанием иска являются обстоятельства, подтверждающие наличие у истца права собственности или иного права на имущество. Правовой основой этого иска является ст. 12 ГК РФ предусматривающая такой способ зашиты гражданских прав, как их признание.

Необходимым условием защиты права собственности путем его признания служит подтверждение истцом своих прав на имущество. Это может вытекать из представленных им правоустанавливающих документов, свидетельских показаний, а также любых иных доказательств, подтверждающих принадлежность истцу спорного имущества. Если имущество находится во владении истца, его права на имущество защищает презумпция правомерности фактического владения.

Так как иски о признании права собственности, с одной стороны, не связаны с конкретными нарушениями правомочий собственника, а с другой - диктуются продолжающимся незаконным поведением третьего лица, на них, как и на негаторные иски, не распространяется действие исковой давности.

На основе материалов второй главы можно сделать выводы. Гражданско-правовые способы защиты права собственности включают: иск об истребовании имущества из чужого незаконного владения (виндикационный иск), иск об устранении нарушений, не связанных с лишением владения, иск о признании права собственности.

Заключение

На основании вышеизложенного можно сделать следующие выводы. Под правом собственности понимают юридическую категорию, которая представляет собой совокупность установленных государством правовых норм, закрепляющих, регулирующих и охраняющих права субъектов по отношению к собственности. Право собственности как право конкретных субъектов сводится к трем правомочиям: праву владения, праву пользования и праву распоряжения имуществом.

Приобретение и прекращение права собственности происходят в соответствии с требованиями закона при наступлении определенных юридических фактов. В качестве таковых могут рассматриваться как действия лиц, так и совершенно не зависящие от воли людей обстоятельства. В ходе изучения материала выяснено, что к первым относятся сделки (договоры); акты государственных органов и органов местного самоуправления; судебные решения; приобретение имущества по основаниям, допускаемым законом, иные действия граждан и юридических лиц. Ко вторым - событие, например смерть гражданина, вызывающее наследственные правоотношения. Право собственности прекращается с наступлением определенных юридических фактов.

Субъектами права собственности являются граждане (физические лица), их простая совокупность (супруги, семья), а также юридические лица. Последними могут быть как коммерческие, так и некоммерческие предприятия, организации, которые являются едиными и единственными собственниками своего имущества.

Объектом права собственности может быть любое имущество, в том числе различные виды недвижимости, включая земельные участки, предприятия как имущественные комплексы, а также оборудование, транспортные средства и другие средства производства. Количество и стоимость имущества, находящегося в собственности граждан и юридических лиц, могут быть ограничены только на основании закона. В гражданском праве одной из форм собственности является собственность государственная (федеральная и субъектов Федерации) и муниципальная.

Гражданско-правовые способы защиты права собственности включают: иск об истребовании имущества из чужого незаконного владения (виндикационный иск), иск об устранении нарушений, не связанных с лишением владения, иск о признании права собственности.

Под виндикационным иском понимается внедоговорное требование не владеющего собственника к фактическому владельцу имущества о возврате последнего в натуре. Для предъявления виндикационного иска необходимо одновременно наличие ряда условий. Во-первых, требуется, чтобы собственник был лишен фактического господства над своим имуществом, которое выбыло из его владения. Во-вторых, чтобы имущество, которого лишился собственник, сохранилось в натуре и находилось в фактическом владении другого лица. Право на виндикацию принадлежит собственнику, утратившему владение вещью. Однако наряду с ним виндицировать имущество может также лицо, хотя и не являющееся собственником, но владеющее имуществом в силу закона или договора.

Правом на негаторный иск обладают собственник, а также титульный владелец, которые владеют вещью, но лишены возможности пользоваться или распоряжаться ею. В качестве ответчика выступает лицо, которое своим противоправным поведением создает препятствия, мешающие нормальному осуществлению права собственности (права титульного владения). Предметом негаторного иска является требование истца об устранении нарушений, не соединенных с лишением владения. Вопрос об истребовании вещи у добросовестного приобретателя решается в зависимости от того, как приобретена вещь - возмездно или безвозмездно.

Также установлено, что право собственности может защищаться с помощью иска о признании права собственности. Это внедоговорное требование собственника имущества о констатации перед третьими лицами факта принадлежности истцу права собственности на спорное имущество, не соединенное с конкретными требованиями о возврате имущества или устранении иных препятствий, не связанных с лишением владения. Иск о признании права собственности может быть заявлен собственником веши, как владеющим, так и не владеющим ею, права которого оспариваются, отрицаются или не признаются третьим лицом, не находящимся с собственником в обязательственных или иных отношениях по поводу спорной вещи.
